How Does the Juvenile Justice System Work?
The juvenile justice system handles most crimes committed by individuals under 18 years of age. The primary goal of the juvenile system is rehabilitation, not punishment. This means that the system is designed to help young people correct their behavior and reintegrate into society. However, in serious cases, the charge may warrant the child be tried as an adult, exposing them to adult penalties.
Common Juvenile Crimes
Most common juvenile offenses include:
- Theft & Shoplifting: Stealing goods from stores, or taking property without permission.
- Battery & Assault: This involves physical contact (battery) or threats of violence (assault), frequently arising from school fights or altercations with peers.
- Criminal Mischief (Vandalism): Damaging or defacing property, including graffiti, broken windows, or destruction of school or community property.
- Trespassing: Being on private property or school grounds without permission, often after hours or during suspension.
- Drug Offenses: Possession of marijuana or other controlled substances, even in small amounts, remains illegal and can carry lasting consequences.
- Underaged Drinking: It is unlawful for anyone under 21 to possess or consume alcohol.
- Weapon Possession: Possessing a firearm, knife, or prohibited item is a serious offense that may bring about serious consequences.
- Cyberbullying & Online Threats: This is the use of text, social media, or email to harass, threaten, or intimidate others. These charges are increasingly common among teens.
- Traffic Violations: Offenses like reckless driving, driving without a license, or driving under the influence of alcohol or drugs, can result in serious criminal consequences.
A minor convicted of a crime can face penalties that include imprisonment, probation, and/or community service. The court may also order a visit from Child Protective Services to assess whether to remove the minor from the parents’ home.
