What is Considered Leaving the Scene of an Accident?
Drivers in Florida involved in a motor vehicle accident with property damage are required to stop immediately at or near the scene of the crash to provide their name, address, driver’s license, and vehicle registration to the other party or law enforcement, and render reasonable aid if needed. Florida Statute § 316.061 states that leaving the scene of the accident without satisfying the necessary requirements is a criminal offense under Florida law. Failure to do so can result in criminal charges that vary in severity:

- Property Damage Only: Leaving the scene is charged as a second-degree misdemeanor, punishable by up to 60 days in jail and a $500 fine.
- Injury to Another Person w/ Minor Injuries: This becomes a third-degree felony, with penalties of up to 5 years in prison and a $5,000 fine.
- Injury to Another Person w/ Serious Bodily Injury: This is a second-degree felony, carrying up to 15 years in prison.
Accident involving a Fatality: Under Florida Statute § 316.027, fleeing an accident scene involving a fatality is a first-degree felony, punishable by up to 30 years in prison, a minimum mandatory sentence of 4 years, and long-term driver’s license revocation.
